Council secures injunction preventing disclosure of contents of 11+ exam

Warwickshire County Council has obtained a High Court injunction preventing an individual from publishing or disclosing the content of its 11+ examination paper.

Mr Justice Newey granted the injunction after a four-day hearing at Birmingham District Registry.

The local authority made an emergency application in September 2013 when it discovered that information pertaining to be the contents of its examination, which was to be used again for children unable to attend the first sitting, was being advertised on the defendant’s website.

The defendant argued that once sat, the contents of the exam were public knowledge and therefore not protected by the law of confidentiality.

However, Warwickshire countered that the test contents were not in the public domain, despite the fact that some children had already sat the exam.
