A zero sum game?

The number of SEND tribunal cases is rising and the proportion of appeals ‘lost’ by local authorities is at a record high. Lottie Winson talks to education lawyers to understand the reasons why, and sets out the results of Local Government Lawyer’s exclusive survey.

School and family settle legal row over length of skirt

A 12-year-old Muslim girl has been told she can continue to wear a long skirt for religious reasons after the settlement of a dispute with Uxbridge High School.

Law firm Mishcon de Reya issued a statement on behalf of Idris Hamud, father of Siham, after it acted for the family.

Sihma had been sent home for contravening the school’s uniform policy by wearing an ankle-length skirt instead of the shorter regulation one.

Mr Hamud said: “We are pleased that Uxbridge High School has listened to our concerns and found that we were justified in raising concerns with the school.

“We are very happy that Siham has been able to resume her schooling, with her right to practice her faith by wearing an ankle-length skirt in the same style as the school uniform skirt now accommodated by the school.

“The school has confirmed that it will not be taking legal action against us for the time Siham was unable to attend school.  We have received a letter of apology.”

He thanked Mishcon de Reya, “which has assisted us with reaching a positive resolution with the school”.

The school has been contacted for comment.
