LLG and AEA obtain advice from QC on date of councillor retirements and start of term of office
- Details
Lawyers in Local Government and the Association of Electoral Administrators have sought legal opinion on the ‘effective fourth calendar date’ under the Local Government Act 1972.
LLG said the legal advice was obtained following requests for clarification on calculating the date of a councillor’s retirement or start of their term of office after scheduled local elections on 2 May 2019.
The legal opinion was provided by leading elections barrister Tim Straker QC of 4-5 Grays Inn.
A summary of the opinion can be found on the LLG website here. A copy of the opinion itself can be found here.
