Residents fail in legal bid to stop demolition of flyover as part of Commonwealth Games works

A group of residents has failed to win permission for a judicial review challenge over a decision by Birmingham City Council to demolish the A34 Perry Barr flyover.

The A34 Safety Action Group said the three claimants had been ordered to pay £4,000 towards the local authority’s legal costs. A Crowd Funder page has been set up.

“Even more disappointing was that the court didn't even consider half of our case,” it claimed.

The council’s decision to demolish the flyover is part of work to develop the Commonwealth Games Athletes Village.

Petitions against demolition received more than 8,000 signatures.

Cllr Waseem Zaffar, Cabinet member for Transport and Environment at Birmingham City Council, told the Birmingham Mail: “We are pleased with the decision of the court. It entirely justifies our position to robustly defend the claim which we have consistently said was without merit.

“Our focus now will be on delivering a highways improvement scheme that makes Perry Barr the best-connected district in Birmingham.”
