You might have heard of the recent decision of the European Court of Justice known as “Schrems 2”. The court decided that the EU-US Data Transfer programme (the “Privacy Shield”) was unlawful. It also imposed hurdles on the use of Standard Contractual Clauses

This decision has implications not only for transfers of personal data to the US but for transfers anywhere outside the EU. It also affects the UK’s position after the Brexit Transition Period.
