On 1st September 2020, in Cornerstone Telecommunications Infrastructure Ltd v University of the Arts London, the Upper Tribunal declined to impose an agreement conferring on a telecommunications operator rights to install and operate equipment on the roof of a building. It is the first time that the Tribunal has found that the test in Communications Act 2003 Sch.3A Pt 4 para.20 was not satisfied. The Tribunal went on to consider in detail what the appropriate terms of the code agreement would have been, had it decided to impose one.

At this webinar, Toby Watkin and Jonathan Wills will discuss this important decision (and some of the other important recent decisions in this field). They will consider what it means for a party who is seeking to resist the imposition of a Code agreement, or who wishes to alter the terms of the agreement which an operator is seeking to impose. Miriam Seitler will chair the discussion and put questions from those attending.
