This webinar will explore the issues of the creation, transmission, and extinguishing of restrictive covenants in the conveyancing process. The training is suitable for both residential conveyancers and commercial property lawyers at all levels.

It will examine:

  • How restrictive covenants can be established and the transmission of restrictive covenants in the conveyancing process.
  • Land Registration issues on the creation of restrictive covenants
  • Using restrictive covenants to protect overage
  • Applications to remove or vary restrictive covenants via S84 LPA 1925 and S610 of the County Courts Act
  • Due diligence when acting for a buyer – is the covenant enforceable, if so by who has it been properly protected and what is the impact of the covenant on the objective of the client
  • Using title indemnity policies
  • An examination of relevant recent case law in particular the decisions in Alexander Devine Children’s Cancer Trust v Housing Solutions [2020] UKSC 45 and 89 Holland Park Management Ltd v Sophie Louise Hicks [2020] 6WLUK 198

Using examples and case studies the course will consider how restrictive covenants can impact on the conveyancing process.

Extensive notes will be provided and there will be an opportunity for delegate questions.
