The Kingdom of Saudi Arabia(KSA) has enacted its first comprehensive national data protection law to regulate the processing of personal data.
The KSA Personal Data Protection Law (KSA PDPL) was passed by Royal Decree M/19 of 9/2/1443H on 16 September 2021.
It will be effective from 23rd March 2022 following which there will be a one-year implementation period.
This is an important development as, for the first time in Saudi Arabia, Data Subjects have new rights over their personal data and organisations have strict obligations to protect individual’s privacy. Organisations based in the KSA as well as international businesses need to assess the new law’s impact on their data processing activities. Systems and processes need to be put in place to ensure compliance.
Failure to do so will not just lead to enforcement action, including substantial fines, but also reputational damage.
