Description

Transfers of personal data from the UK to other countries, including to the EEA, are subject to transfer rules under the UK GDPR which broadly mirror the EU GDPR.

There is still much confusion about this topic especially following the judgement of the European Court of Justice in “Schrems II” and the issuing of new EU standard clauses.

On 28th January 2022, the Secretary of State laid before Parliament the international data transfer agreement (IDTA), the international data transfer addendum to the European Commission’s standard contractual clauses for international data transfers (Addendum) and a document setting out transitional provisions.

The IDTA and Addendum came into force on 21 March 2022 replacing the current standard contractual clauses for international transfers and take into account the Schrems decision. This webinar will guide you through the main issues when using these documents and what the alternatives are. We will also examine the recently announced international transfer agreement between the US and EU, replacing Privacy Shield, and its impact on the UK.

 Key Topics

  • International transfer rules
  • What are “appropriate safeguards”?
  • Differences between transfers under EU GDPR and UK GDPR transfer regimes
  • What the Schrems decision means for international transfers
  • The newly announced EU-US data transfer arrangements
  • How to use the new UK IDTA and Addendum
