Transfers of personal data from the UK to other countries, including to the EEA, are subject to transfer rules under the UK GDPR which broadly mirror the EU GDPR.
There is still much confusion about this topic especially following the judgement of the European Court of Justice in “Schrems II” and the issuing of new EU standard clauses.
On 28th January 2022, the Secretary of State laid before Parliament the international data transfer agreement (IDTA), the international data transfer addendum to the European Commission’s standard contractual clauses for international data transfers (Addendum) and a document setting out transitional provisions.
The IDTA and Addendum came into force on 21 March 2022 replacing the current standard contractual clauses for international transfers and take into account the Schrems decision.
