Introduction

For almost 30 years Trevor Roberts Associates (TRA) hosted the ever-popular Forum on Enforcement. This provided excellent CPD and a valuable opportunity to meet and exchange views and experiences with a wide spectrum of planning enforcement practitioners.

Sadly, TRA ceased trading in 2020, however IVY Legal are delighted to be able to announce that the Forum will continue, in the now familiar format.

Plenary Sessions

As enforcement can become particularly litigious it is vital that we all keep up to date with recent case law. The day will therefore begin with a Legal Update given by solicitor IZINDI VISAGIE. Izindi founded Ivy Legal in response to a need for more effective planning enforcement, using her local government, third sector and business experience. Ivy Legal act on behalf of many local authorities and understand how important effective planning enforcement is.

The afternoon plenary session will be given by SCOTT STEMP from no 5 Chambers who will look planning injunctions and how to be successful in obtaining one when you really need to!

Parallel Sessions

Three parallel sessions will be run once before and once after lunch enabling participants to attend two out of the three sessions but in a smaller, more informal group.

CRAIG ALLISON is Senior Planning Enforcement Officer at Hambleton District Council. Craig is also Chair of the National Association of Planning Enforcement (NAPE), and one of the authors of the recently published Beginners' Guide to Planning Enforcement.

ANDREW JAMES is Planning Enforcement Manager at Test Valley Borough Council. Given that the starting point for any investigation relating to a possible material change of use has to begin with the identification of the correct planning unit, Andrew will explore this important concept with reference to real life examples and case law.

MICHAEL HYDE is former Local Authority Enforcement Officer who now runs his own Independent Planning Consultancy. Michael will look in some detail at caravans, specifically in the context of the 1960 Caravan Sites Act. What is a ‘caravan’, what is it that distinguishes a caravan from a ‘building’, and if the siting of a caravan is a use of land, what makes a change of use ‘material’?

Chair

The Forum will be chaired by MARK TURNER, Head of Planning at Great Yarmouth Borough Council.

The Forum will be practically oriented and delivered in a structured but informal way. As previously, there will be ample opportunities for discussions and exchanges of experience.
