DWF - Subsidy control and "direct development"/ in-house commercial projects for local authorities

This session will explore the often vexed issue of subsidy control when local authorities seek, through different funding mechanisms (central government grant or otherwise) to deliver "commercial projects". This can be via direct development of new real estate or provision of infrastructure or services in competition with the market.

The session will include lessons from the first Subsidy Control Act judgment in Durham Co. Limited v Durham Council [2023]
