Yorkshire CCGs look to appoint single legal firm on retainer

Two clinical commissioning groups in Yorkshire are to appoint a single legal firm to provide legal advice and support on a retainer basis.

NHS Calderdale CCG and NHS Greater Huddersfield CCG said the appointment would enable a single point of contact for accessing legal assistance swiftly.

“Such an agreement will also allow the development of strong working relationships between the legal firm and the CCGs who are party to this agreement,” it said.

A broad indication of the types of services required:

  • Advice on how to reduce the risk of judicial challenges to the CCGs’ decisions and advice on acting on behalf of the CCGs’ decisions when they are challenged in the Courts;
  • Advice on public engagement / consultation;
  • Areas related to the Better Care Fund Programme and co-commissioning;
  • CCG Corporate Governance including advice on statutory duties and CCG Constitution;
  • Complaints and potential claims;
  • Continuing health care retrospective claims;
  • Continuing health care case law;
  • Contracting and Procurement;
  • Employment law and pensions;
  • Estates;
  • Freedom of Information and Subject Access Requests;
  • Mental Capacity Act, Deprivation of Liberty and Court of Protection;
  • Serious Case Reviews and Serious Adult Reviews;
  • Supporting the CCGs at any judicial review or more extreme legal challenges and, if required, instruct and engage counsel on behalf of the CCGs.

The indicative value of the contract is £25,000 - to be invoiced monthly.

The closing date is 10 July. The contract start date is 1 September 2015 and the end date is 31 August 2016.
