This webinar will explore how and when to deploy the CMO principle in managing issues of Subsidy Control, and crucially how to ensure there is an adequate evidence base for concluding this reliably and in a manner that will stand up to challenge.
In considering this we will be looking carefully at the challenge process and how it unfolds even for supposed non-subsidy measures, and most particularly the judgements in Weis v GMCA, first considered by the CAT in Summer 2025, and drawing the lessons from this case and relevant economic and financial expert analysis.
